DM Getaways Global LLC, a corporation incorporated under the laws of Florida (“DM Getaways,” “we,” “us,” or “our”), provides a marketing and discovery platform that helps property owners and managers promote their accommodations directly to prospective guests.
DM Getaways is a directory and marketing service only. We do not process bookings, handle payments, broker transactions, or act as a travel agency, booking platform, property manager, or payment intermediary. All bookings, payments, cancellations, refunds, and guest communication are handled directly between the Host and the Guest.
“Discovery Services” means the listing, marketing, search, and promotional services provided by DM Getaways through its platform.
“Direct Link” means the Host’s own booking URL, website, or booking method displayed on the Platform.
“Host” means the property owner, manager, or authorized representative who subscribes to the Discovery Services.
“Guest” or “User” means any person who visits the Platform to discover Host listings.
“Listing” means the Host’s profile displayed on the Platform, including property information, photographs, amenities, pricing, and Direct Link.
“Term” means the applicable subscription period and any renewal period.
DM Getaways provides access to Discovery Services so that prospective guests can find Host listings and contact Hosts directly through the Direct Link provided by the Host.
The services may include listing display, searchable directory features, property photos, descriptions, amenity information, seasonal pricing, basic analytics, and technical support related to platform functionality.
We may update, modify, suspend, or discontinue features at any time.
The Host is solely responsible for the accuracy, legality, and completeness of all listing content and for keeping all information up to date.
The Host is also solely responsible for:
the operation and maintenance of the property;
all guest communications;
all booking arrangements and payment collection;
all taxes, licenses, permits, insurance, and legal compliance;
all guest safety, property access, and service standards.
DM Getaways does not verify or guarantee the legality, safety, quality, or compliance of any property, listing, or Host activity.
Subscription fees are charged by DM Getaways for access to the Discovery Services. The Host is responsible for paying the applicable subscription fee and any related taxes based on jurisdiction.
DM Getaways does not process guest payments or booking funds. All guest charges are handled directly by the Host through the Host’s own systems.
If a subscription payment fails or is disputed, DM Getaways may suspend access until payment is resolved.
The subscription renews automatically unless cancelled before the renewal date in accordance with the cancellation process shown on the Platform.
If the Host cancels, the cancellation takes effect at the end of the current billing period. No refund is provided for any unused portion of the current billing cycle unless required by law.
The Host retains ownership of all content submitted to DM Getaways, including photos, descriptions, logos, and listing materials.
By submitting content, the Host grants DM Getaways a non-exclusive, royalty-free license to use, display, reproduce, and format that content as needed to operate, market, and improve the Platform.
The Host confirms that it has the right to share all submitted content and that the content does not infringe the rights of any third party.
DM Getaways retains ownership of its platform, branding, software, and related intellectual property.
DM Getaways and the Host are independent businesses and each is responsible for complying with applicable privacy and data protection laws.
DM Getaways may collect and process Host account details, subscription information, listing content, and technical usage data necessary to operate the Platform.
The Host is responsible for any personal information collected through the Host’s own booking systems, websites, payment tools, or communications with guests.
Each party will maintain reasonable security measures for the data it processes and will notify the other party of any material data breach where required by law.
DM Getaways may suspend or terminate access if the Host breaches this Agreement, provides false or misleading information, violates applicable law, or engages in conduct that harms the Platform or its users.
The Host may stop using the services and cancel the subscription according to the cancellation process on the Platform.
After termination, the Host’s listing may be removed, and any license to use the Platform or DM Getaways branding will end.
DM Getaways is not responsible for any loss, injury, damage, dispute, or claim arising from the Host’s property, services, listings, guest interactions, bookings, or payments.
To the maximum extent permitted by law, DM Getaways’ liability is limited to the amount of fees paid by the Host during the twelve months before the claim arose.
DM Getaways is not liable for indirect, incidental, special, or consequential damages.
This Agreement is governed by the laws of the State of Florida.
The parties agree to try to resolve disputes in good faith before starting formal proceedings. If a dispute cannot be resolved informally, it may be resolved through binding arbitration or another process required by law or agreed by the parties.
If any part of this Agreement is found unenforceable, the remaining parts will remain in effect.
This Agreement, together with any related website policies, forms the full agreement between the parties regarding the Host’s subscription and use of the Platform.
